Legislation
All wild birds in the UK are protected by the Wildlife and Countryside Act 1981 and cannot be killed or taken except under licence. In Scotland The Nature Conservation (Scotland) Act 2004 introduced the concept of recklessness to the Wildlife and Countryside Act 1981.There are a number of offences relating to birds in section 1 of the Wildlife and Countryside Act 1981 including to intentionally or recklessly:
-
Kill, injure or take any wild bird
-
Take, damage, destroy or otherwise interfere with the nest of any wild bird while that nest is in use or being built
-
Obstruct or prevent any wild bird from using its nest
-
Take or destroy an egg of any wild bird.
Some birds, including many birds of prey, are on Schedule 1 of the Wildlife and Countryside Act 1981 and are specially protected. It is an offence to intentionally or recklessly disturb them while they are building, or are in, on, or near a nest containing eggs or young, or to disturb their dependent young.
